I need some advice:
The exact charges are:
1. Gross Negligence
2. Gross Insubordination, serious disrespect, impudence or insolance
Two weeks ago the emploeyer sent me an e-mail stating that my work is not up to KPI levels and the e-mail constitutes a Final written warning. I rejected the e-mail by forwarding it to our head office Human resources department.
On friday the employer slaps me with the above charges. On neglegience because some of the work has not been even though I did not have enough people nor did I have the some ideal circumstances to perform.
Gross insubordination because of the e-mail sent to the HR department and dishonesty, according to my Manager I lied in the e-mail.
Also they made sure that both my witness are out of town
I need some urgent advice as the hearing is tomorrow
You are entited to have witnesses present and if your witnesses are out of town, you can ask for a postponment so that your witnesses can attend the hearing.
Or if no appeal procedure is in place a dispute at the CCMA.
