Unauthorized Absenteeism-Arrested for drunken driving

Good day,
One of our employees is on a final written warning for unauthorized absenteeism.
Last Thursday and Friday once again he did not report for duty and did not notify anyone that he would not be at work.
He reported for duty this morning (Monday) with and affidavit that he was arrested on Wednesday evening and spent two days in prison until his bail was paid.
I have seen that this can not then t be regarded as absence without leave, desertion or abscondment because the employee was not wilfully absent.
Is there no disciplinary action that i can take against the employee?
Please advise.

Unless your disciplinary code provides otherwise, none. Sorry.
