dismissal sanction

hi there
please advise ,should a dismissal sanction be given by a chairperson of the hearing only or can it be given by a HR rep?

if a person gets dismissed for a compliance issue that she has been given multiple warnings for without suspension during the hearing,meaning she still had to work even tho the company saw her as a risk to business, would she have a leg to stand on at the ccma for unfair labour practice?

No to your second question. The mere non-suspension of an employee will not suffice in proving that the trust relationship has not been damaged beyond repair. It may, however, be considered as but one factor.
