Contract Type

Unread post by ThokoAM » 29 Sep 2017, 14:45

I am working for an SME company with 30 employees and they have 3 types of contracts: Fixed Term (6 and 12 months contracts, renewable after expiry date, some employees have been with the company for more than 3 years), Permanent (without benefits) and Independent Contractors.

Please can you assist with defining the different types of contracts. These are the scenarios we have:
• contract with a start and finish date, with an agreed amount of money and they are on our payroll (100% time)
• contract with a start and finish date, with an agreed amount of money and they are on our payroll (work less than 100%)
• contract with a start and finish date, with an agreed amount of money and they are NOT on our payroll – they invoice us (100% time)
• contract with a start and finish date, with an agreed amount of money and they are NOT on our payroll – they invoice us (work less than 100%)
• individuals who come and do “pieces” of work for us on an ad hoc basis

I need to make sure we are aligned to legislation in terms of contract, tax implications and benefits.

Impossible to advise without having had a look at the contracts, sorry. You may email them to me at ghwirconsult@gmail.com.
