Employee Quits then returns for work the following day

Unread post by cardel5477 » 14 Jul 2016, 08:29

HI,
One of our employees handed in her keys, took her personal belongings and said she was not returning.
She arrived at work this morning as if nothing had happened.

We have taken it that she quit her job and I would like to know if she has a cooling off period and can in fact return to work, or can we accept that she quit and pay her what is due and move on.

Kind regards
Carmen

She did not resign - in terms of the BCEA a resignation must be in writing (unless she is illiterate). The best you could do is to give her a warning for AWOL.
