Sub contractor coverage under the COID Act

Good day


I have to employ a subbie without a valid LOGS. The subbie does have the DOL Tender letter document stating that once the tender is approve the subbie will be oblige to obtain a LOGS within 7 days of first employment of staff.. I know COID Act sec 89 state that the staff of the subbie will be regarded as the principal`s employees if the subbie is not registered with DOL

So I take it then that should an IOD happen on site within this 7 day period that the Commissioner will cover that IOD.
What happens after the 7 day period and the subbies has still not obtain a LOGS ??
The principal will then be liable to pay that IOD under his LOGS, correct ??
