Contractor working at private residence

Good Day,
Thank you for an excellent forum.
There are two separate contractors working at a private residence, the one has a letter of good standing with Occupational health and safety and the other contractor is not registered with them. Should one of the unregistered contractors employees get injured on duty who would be held responsible for the costs involved in treating and paying the injured employee ?

Hi Tinus,
If you're working at a private residence, should the home owner who is employing the contractors check that they have a letter of good standing?
If he/she employs a contractor who is non compliant and one of the employees is IOD, could the homeowner,being the Employer be held liable ?

Hi there

If it is a double story building the answer would be yes (see CR 2014/ Reg 2 scope of aplication).

If not, the contractor still needs to comply as nan employer but the client would not be obligated to ensure compliance (duties of the client reg 3 of the CR would not be applicable).
