Hi,

is the PTO a legal requirements if yes, where is it stated in the OHS Act?

The OHS Act is largely based to the principle of self-regulation by employers.

A PTO would form part of the control procedures implemented by management in order to ensure legal compliance (continues risk assessment).

Hi Tinus,

if being audited and you do not conduct PTO's is it a non-compliant or it can be stated as a recommendation?

I agree, it should be a recommendation and not a non-conformance (unless prescribed by your own policies & procedures).
