Appointments

Hi Everyone

Hope you can assist me with the following scenario.

if an organisation has many branches, each branch has its own General Manager, Production Manager, Maintenance Manager, and Safety manager. who gets appointed as the 16(1) and who gets appointed as the 16(2)?

Is it possible to appoint the General Manager as the 16(1) by the board of directors and then permit the General Manager to appoint the Production, Maintenance, and Safety Manager as the 16(2)? OR

should the chairperson of the board of directors appoint the General Manager as a 16(2) and also appoint the Production, Maintenance, and Safety Manager as 16(2)?

The Production, Maintenance and Safety Manager all Report to the General Manager, and the General Manager will then Report to the Board of Directors. however the General Manager does not own any shares in the organisation or branch. The General Manager however do in most cases interview and hire the management team of that branch.

The wording of the appointment letters would be important (stipulating for example that the other 16(2) appointees should report to the GM and in his absence to the chairperson of the board).
