The employee is allowed to approach the CCMA directly after dismissal.
This is applicable even if you have an appeal process in place.
Please prepare for the arbitration as indicated above.

The reality is that the employee does not have any sick leave at his/her disposal.
During the first six months of employment the employee will only receive one day's paid sick for every completed year of service.
The sick leave will therefor be unpaid

There are no sectoral determination for the building industry.
However if you are a member of a bargaining council or if you are bound to a collective agreement in your industry then you will have to adhere to the main agreement.

As far as I know a person only qualifies for one benefit. The person will therefore not qualify for UIF as she already receives a grant from government.

Employees are entitled to sick leave if they are sick.
The abuse of sick leave is misconduct, you need to follow your disciplinary procedures.
